Policy on Respect for Privacy When Images are Collected by Surveillance Cameras at the FPS Economy

The FPS Economy respects the privacy of the people who are filmed by the surveillance cameras.

This Policy on Respect for Privacy describes how we handle the personal data we collect through the use of surveillance cameras. We process your personal data in accordance with all the applicable regulations concerning the protection of personal data.

Personal Data

The personal data we collect are the images captured by the video surveillance cameras. The cameras only record images. No conversations are recorded.

Basis of the Processing

Processing is necessary for the performance of a mission in the public interest in accordance with Article 6(1)(e) of the General Data Protection Regulation. [1] The legal basis is article 3 of the law of 21 March 2007 concerning the regulation of the placement and use of surveillance cameras (hereinafter ‘Camera Act’).

Purposes

The camera surveillance system is used exclusively for access control and security purposes, i.e. to secure buildings, protect staff, and prevent and detect crime, damage, and nuisances. This means that the cameras and images are used to help prevent, deter and, if necessary, investigate possible illegal entries, enable immediate action in the event of crime, damage or nuisance, gather evidence of such acts and identify offenders, witnesses or victims. Authorised personnel can therefore view the images both in real time and subsequently.

Transfer of Personal Data

In accordance with article 9 of the Camera Act:

  • the Data Controller may send the images to the police or judicial authorities if events are established that constitute a potential crime or nuisance and if the images can help to prove these events and to identify the perpetrators, and;
  • the Data Controller must send the images to the police if they request them within the framework of one of their tasks of administrative and judicial police and if the images concern the recorded crime or nuisance.

Under no circumstances does the FPS Economy transfer data to recipients outside of the European Union.

Retention Period

The images captured will be kept for a maximum of one month, unless otherwise ordered by law enforcement officials and unless the images can contribute to the detection and solving of a criminal offence. Images older than one month will be destroyed automatically by the video surveillance system.

Your Rights

You have the right to access the images that concern you. To do so, you must specify in your application when, within a period of approximately one hour, you entered the monitored area. You also have the right to ask the Data Controller to rectify the images or restrict their processing and the right to object to their processing.

In order to exercise your rights, send an email or a letter to the Data Controller and attach a scan or a copy of your identity card, including your signature.

Updating this Policy

This policy can be adjusted at any time to reflect changes in our activities or in the legislation. These adjustments will always be in accordance with the current legal provisions.
