On 13 December 2024, Regulation (EU) 2023/988 on general product safety will enter into force. This regulation introduces many new requirements for products intended for consumers. The obligations of the various market participants involved in the consumer product distribution chain are described in even greater detail. They contain specific obligations for online marketplace providers in relation to product safety.
Online marketplace providers will now have specific obligations to ensure the safety of products marketed through their platform. For example, they must:
- Designate contact points for consumers on the one hand and authorities on the other
- Register on the Safety Gate portal, the EU's rapid alert system for hazardous non-food products
- Establish internal processes for product safety
- Cooperate with the authorities, in particular by removing or making inaccessible specific content relating to an offer of a dangerous product and any identical offers
- Set up their platform so that professionals offering products on it can meet their obligations.
