For which problems
For any problem dealing with real estate such as a dispute with a contractor, architect, surveyor, property developer; a dispute dealing with a new building, renovation works, co-ownership, right of way, town planning, common ownership, construction flaw, renting, leasing, real estate sales, real estate agent contracts, environment or salubrity problems…
Two prerequisites for access:
- You must have tried to solve the dispute directly with the company, to no avail ;
- You must formally (by letter) entrust the Board with an arbitration mission (standard clause (in French))
During a first contact, I will check whether your dispute can be dealt with amicably or not. I will give you any useful information about my possible intervention. My rate will only start to apply when you and the other party have formally assigned me my mission.
50 euro for each party (administrative costs) + 85 euro (VAT not included) per hour of work for each arbiter (with an advance to be paid in some cases) + expert fees if necessary.
How does it work?
Two approved mediators will help the parties to find (by themselves and through reasonable negociation) a solution in their interest. There is always at least one jurist and one technician specialised in the matter concerned. A solution is usually found within two months. In case of failure, the parties can still try arbitration or take the matter to a court. .
Explain the problem in a letter and enclose a copy of any useful document.
