Before the mediator can take any action, each party involved in the procedure has to pay a provision of 130 euros VAT included (2 hours) on the mediator’s bank account. This sum will be used to cover the first expenses and will be deducted from the final bill.

Unless agreed otherwise, the mediation fees are paid in equal parts by each party involved in the mediation process. If there are more than two parties in the process, each additional party will be invited to pay the same amount.

    How does it work ?

The mediator is registered with the FPS Justice in compliance with the act of 21 February 2005 amending the Judicial code as regards mediation. He follows the strict ethical principles inherent to his function. The mediator is neutral and accepted by both parties. He cannot testify in a court of law and does not send any report to the judge. The content of the discussions is strictly confidential, with the possible exception of the agreement protocol signed by both parties.

The mediator facilitates discussion, defines the conflict and identifies and clarifies the choice. Without imposing a solution, he enables the parties to exchange their points of view in a constructive dialog. He encourages communication and thinking in an atmosphere of mutual listening, respect and trust, which favours creativity. Finally, he makes it possible to find an agreement which complies with regulation and meets both parties’ interests.
