    Since 1 June 2024, a new procedure makes it possible to apply urgently to the president of the Brussels Business Court for provisional measures to put an end to a clear and substantial infringement of:

    • a copyright,
    • a neighbouring right, or
    • the rights of a database producer, committed online.

    This new procedure also applies to the illegal operation of online gambling services.

    In this context, the judge will be assisted by the Service de lutte contre les atteintes au droit d’auteur et aux droits voisins commises en ligne et contre l’exploitation illégale de jeux de hasard en ligne (Service for Combating Online Piracy and Illegal Online Gambling), which is part of the Directorate-General for Economic Inspection of the FPS Economy.

    Among other things, the service may be empowered by the president of the court to determine the modalities of application of the decision, in cooperation with Internet service providers (blocking of sites, identification of mirror sites, etc.).

    The service is also responsible for keeping an up-to-date list of the websites that have been subject to the measures.
