On 3 November 2025, the Copyright and Related Rights Section of the Intellectual Property Council adopted an opinion on the impact of the European Court of Justice's judgment ONB C-575/23 of 6 March 2025 on the provisions of Titles 5, 6, 7 and 8 of Book XI of the Code of Economic Law.
This judgment concerns the (in)admissibility of transfers of intellectual property rights by regulatory means in the light of the European and international framework.
The Intellectual Property Council, Copyright and Related Rights Section, concludes that the provisions of the Code of Economic Law examined in its opinion are compatible with the findings of the European Court of Justice's judgment ONB C-575/23 of 6 March 2025 and do not require legislative amendments.
