With regard to plant breeders' rights, the Belgian Intellectual Property Office is assisted by the Plant Breeders' Rights Council. This scientific council advises on issues related to the protection of plant breeders' rights and is composed of:

  • twelve persons with specific competence in the field of genetics, botanics or plant cultivation, respectively of agricultural crops, vegetables and fruit, non-edible horticultural products and forest crops; 
  • three persons who are in particular competent in the field of intellectual property.

The members of the Council have been appointed for a period of five years and their mandate can be extended. The Council appoints a president and a vice-president.

The secretariat of the Council for Plant Breeders' Rights is provided by the Belgian Intellectual Property Office.
