You can search in design rights databases to find out whether a design has already been registered. This search could be useful for determining whether an identical design to the one you wish to protect already exists. In this case, your own design will not have the novelty which is required in order to be registered; using it could be considered a violation of an existing design right.
The Benelux register of designs is not yet available online, but, for a fee, searches can be carried out by the Benelux Office for Intellectual Property (OBPI).
The results of database searches are not exhaustive because many designs are not registered or are confidential. We recommend that you request assistance from an intellectual property specialist when interpreting the results.
