    Construction Products Regulation (EU) 2024/3110 introduces new obligations for manufacturers, including the preparation of a Declaration of Performance and Conformity (DoPC) and the affixing of the CE marking. The DoPC replaces the Declaration of Performance (DoP) and, in addition to essential technical performance, also covers safety, environmental, and climate-related characteristics.

    Declaration of Performance and Conformity

    The DoPC is an essential document in which the manufacturer confirms that a construction product complies with the established performance and conformity requirements.

    The DoPC is drawn up in accordance with the model in Annex V of Regulation (EU) 2024/3110.

    Content of the Declaration of Performance and Conformity

    The information in the Declaration of Performance and Conformity allows economic operators and authorities to verify the product's conformity and ensure that it meets the applicable requirements.

    The DoPC contains the following information:

    1. Product description
      • Unique identification of the product, including product type, serial or batch number.
      • Product category as defined by the harmonised technical specifications or European assessment documents.
      • Use of the product, as defined in the applicable harmonised technical specification assessment documents.
      • Nominal dimensions or grading of the product.
      • Key parts of the product, where applicable.
      • Estimated service life time for the declared use (durability information).
      • Variants, if any, and their descriptions.
      • Information on the deinstallation, if the product has been previously installed in a construction work (date and place).
         
    2. Permalinks or data carriers
      The following additional information must be included in the declaration and made available via permalinks or data carriers, unless that information is stored digitally in the product passport:
      • Product registrations of the manufacturer in EU databases, if applicable.
      • Information to be provided in accordance with Regulation (EC) No 1907/2026 (REACH), if applicable.
      • General product information, instructions of use and safety information pursuant to annex IV.
         
    3. Details of the manufacturer
      • Name of the manufacturer.
      • Registered trade name.
      • Registered place of business and postal address.
      • Telephone, email address and website of the company.
         
    4. Details of the authorised representative (if applicable)
      • Name of the authorised representative.
      • Registered trade name.
      • Registered place of business and postal address.
      • Telephone, email address and website of the authorised representative.
         
    5. Details of the notified body or bodies (if applicable)
      • Name and identification number of the body.
      • Registered trade name, if available.
      • Registered place of business and postal address.
      • Telephone, email address and website of the body.
         
    6. Details of the Technical Assessment Body (TAB) (if applicable)
      • Name and identification number of the TAB.
      • Registered trade name, if available.
      • Registered place of business and postal address.
      • Telephone, email address and website of the TAB.
         
    7. Reference to certificates or validation reports, issued by notified bodies and TABs
       
    8. Technical reference documents
      • Harmonised technical specifications, in which the essential characteristics applied are laid down (reference number and issue date), or
      • applied European Assessment Document (reference number and issue date) and issued European Technical Assessment (reference number and issue date).
         
    9. Declared performances and sustainability characteristics
      • Essential characteristics of the product, as determined in the harmonised technical specifications or European assessment document for the relevant product category for which the performance is declared and the applicable assessment and verification system.
      • The product’s performance expressed in calculated values, levels or classes. Those values, levels or classes are included in the declaration of performance, and cannot simply be included in other documents. For essential characteristics without a declared performance, the term ”NULL” is used instead of a value. The structural behavioural performance of a product can be indicated by referencing the associated production documentation or structural design calculations.
      • The expressed environmental sustainability, for the applicable essential characteristics of the applicable life cycle modules, in accordance with Article 15 (2) of Regulation 2024/3110.
      • Reference to the used software, as provided by the Commission.
         
    10. Applicable product requirements and assessment system
      • The applicable product requirements, as specified by harmonised technical specifications, as well as the applicable assessment and verification system.
      • Reference to the applied voluntary harmonised standard or common specifications including the issue date.
      • Where applicable, information on the product’s performance measured in terms of its product requirements.
         
    11. Declarations of the manufacturer
      The manufacturer declares the following:
      • The product’s performance complies with the declared performances in point 9.
      • The sustainability data of the product have been correctly calculated on the basis of the product category rules applicable to it.
      • The product is in conformity with the requirements listed under point 10.
         
    12. Signature
      The declaration is signed by a representative of the manufacturer, indicating their name, function, place and date of issue, followed by their signature.

    For a detailed description of the requirements relating to the declaration of performance and conformity, please consult Articles 15 and 16 of Regulation (EU) 2024/3110.

    Providing the declaration of performance and conformity

    The manufacturer must provide the DoPC upon delivery of the product or upon request from an authority or another competent party. The DoPC must be:

    1. Digital available:
      The manufacturer supplies by electronic means a copy of the DoPC of each product which is made available on the market, unless the DoPC is included in a digital product passport or is made available on a website.
       
    2. Language requirements:The DoPC is drawn up in the language(s) required by each Member States where the product is placed on the market. If another economic operator makes that manufacturer’s product available in another Member State, they must ensure that translations of the DoPC are available in the languages required by that Member State, together with the original version.

    The manufacturer's obligations with regard to providing the DoPC are set out in Article 16 of Regulation (EU) 2024/3110.

    CE marking

    The CE marking is only mandatory for products for which the manufacturer has drawn up a declaration of performance and conformity in accordance with Articles 13 and 15 of Regulation (EU) 2024/3110.

    Affixing the CE marking

    • The CE marking shall be affixed visibly, legibly and indelibly to the product.
    • If that is not possible due to the product’s nature, the marking may be affixed to a label attached to the product or to the packaging or, if this is also not possible, to the accompanying documents. 

    Information accompanying the CE marking

    The CE marking shall be followed by: 

    1. the last two digits of the year in which the CE marking was first affixed, or, in the case of used products, the last two digits of the year when the product was deinstalled followed by the last two digits of the year in which the CE marking was affixed to the used product; 
    2. the name and the registered address, or the identifying mark allowing easy and unambiguous identification of the name and address, of the manufacturer;
    3. the name and the registered address of the authorised representative, or the identifying mark allowing easy and unambiguous identification of the name and address of the authorised representative where the manufacturer does not have a place of business in the EU or where the manufacturer choses to have an authorised representative;
    4. the unique identification code of the product-type;
    5. the declaration code of the declaration of performance and conformity;
    6. the identification number of the notified body or bodies verifying the product type and assessing the factory production control, if applicable; and
    7. a data carrier connected to the digital product passport if such a passport is available through the construction digital product passport system established pursuant to Article 75 of Regulation (EU) 2024/3110.

    The information listed in points d) and e) may be replaced by a data carrier, including a permalink connected to the DoPC, if that declaration of performance and conformity is available on a website. The information listed in points d) and e) may be omitted if a data carrier referred to in point g) is provided.

    The CE marking may be followed by a pictogram or any other mark indicating a special risk or use.

    Exceptions: When is the CE marking not mandatory?

    Affixing the CE marking is not mandatory for:

    • Products without harmonised standard or European Assessment Document (EAD)
      If no harmonised European standard is available for a construction product and the manufacturer has not obtained an EAD, affixing the CE marking is not mandatory.

      Products covered by an EAD for which a European technical assessment (ETA) has been issued may be affixed with a CE marking.
       
    • Products manufactured in a non-series process
      Custom-made products manufactured in a non-series process in response to a specific order and installed in a single identified construction work are exempt from the CE marking.
       
    • Products intended for traditional and historical renovations
      Products specially designed and manufactured for the restoration of historical or cultural buildings, using traditional methods and materials, are exempt from the CE marking.
