In Belgium, companies that regularly supply natural gas to one or more customers with a permanent consumption of at least one million cubic meters per delivery point per year must obtain a federal supply licence. This licence is mandatory and is issued by the Federal Minister of Energy, except when the supply is provided by a distribution company within its own distribution network.

As a Company, how do You Apply for a Federal Supply License?

To apply for a federal supply licence, you must prepare and submit an application file to the Commission for the Regulation of Electricity and Gas (CREG). The CREG reviews the application to ensure it meets the legal criteria and then submits its opinion to the Federal Minister of Energy, who makes the final decision.

To streamline the process, the CREG provides a manual for preparing and submitting an application file.

The criteria and procedure for obtaining a federal supply licence are outlined in the Royal Decree of 12 June 2001, which regulates the general conditions for the supply of natural gas and the conditions for granting supply licences.

The usual supply of natural gas to end customers located in Belgium, whose gas off-take at each supply point permanently reaches a minimum of one million cubic metres per year, is subject to a federal licensing procedure.

The prior granting of an individual licence is done by the Federal Minister of Energy, except when the supply is carried out by a distribution company within its distribution network.

Applications for supply licences must be addressed to the Commission for Electricity and Gas Regulation (CREG). This commission examines compliance with the criteria and provides its opinion to the Federal Minister of Energy, who decides whether or not to grant the supply licence.
