The old rules on hidden defects will apply again at the end of the two-year legal guarantee (Art. 1641 and subsequent of the Civil Code).
To be able to invoke hidden defects, you must provide proof of the existence of a defect at the time of sale.
The solutions available are more limited than those available under the legal guarantee rules. You can only claim a price reduction or refund.
Disputes and Complaints
Courts:
- Justice of the peace for any dispute less than or equal to 5,000 euros;
- Court of first instance for any dispute over 5,000 euros.
