Belgian Competition Authority

The Belgian Competition Authority is responsible for promoting and safeguarding an active competition in Belgium.

  • To this end it applies the act on the protection of economic competition consolidated on September 15, 2006 (APEC) as well as the community competition rules, such as articles 81 and 82 of the EC treaty and EC Regulation 1/2003.
  • It is part of the European Competition Network (ECN).
  • The Competition Authority examines and may impose sanctions on restrictive practices  (trusts, agreements, abuse of a dominant position).
  • It examines the admissibility of mergers  which have possibly a noticeable effect on the market.
  • On the other hand, the authority has no jurisdiction in respect of unfair trade.

Composition

The Belgian Competition Authority consists of two components:

The Belgian Competition Act also established within the Central Council for the Economy (Centrale Raad voor het Bedrijfsleven / Conseil Central de l’Economie) the Commission for Competition, an advisory body in which the viewpoints of workers and consumers are represented. It has consultative power over the general competition policy.

The Commission for Competition is not a part of the Competition Authority.

Tasks

It is the duty of the Competition Authority:

  • to safeguard and promote an effective competition on Belgian territory.
  • to take part in the implementation of the European competition policy.

The Belgian Competition Authority works together with the other competition authorities and is part of the European Competition Network (ECN), the European Competition Authorities (ECA) and the International Competition Network (ICN).
